1. Definitions
PERFORM BETTER (PB) is the seller of the goods
The ‘Buyer’ menas organisation/body who agrees to buy the goods from the seller as a dealer to resell on. Acceptance of dealer status is subject to PB criteria The ‘Goods’ mean the goods sold by PB Ltd
2. Pricing and VAT –
The prices listed to not contain VAT. This charge will be levied on all items at the prevailing rate, and shown separately when invoiced.
Pricing will be as per the published price list unless otherwise stated. The company has the right to amend prices at any time.
3. Delivery and Packaging:
Charges apply to all UK mainland deliveries.
Delivery will usually be made within 48hours of the order/payment subject to stock availability. Overnight deliveries will incur a further charge at the prevailing rate.
4. Payment Terms
Payment with order or approved accounts only. Accounts are to be settled within 30 days of the date of invoice. Payment of invoice within 14 days will receive a 1.5% reduction apart from credit card payments. The company reserves the right to charge interest at 2.5% per month on overdue accounts.

6. All goods offered are subject to availability and account Status.
7. Overseas orders
Ie Territories outside UK mainland and Northern Ireland. All prices are ex Works Southam. Packaging, FOB and CIF charges will be extra, at cost. Payment will be required before delivery.

9. TITLE
Title of the goods does not pass to the buyer until the invoice is Paid in full. The responsibility and risk in the goods shall pass to the buyer at the point of delivery and PB shall have no responsibility in respect to safety of the goods thereafter and the buyer shall insure with a reputable insurance company for the benefit of PB. PB does not offer sale or return.

10. Claims, Shortages, Damages and Returns
- Notification or damage or shortage must be made to PB within 2 working days of receipt of the goods. If goods are damaged on receipt you may refuse delivery and inform us immediately, confirmed in writing within 5 working days
- Notification regarding non-delivery or the whole or part of a delivery Must be made to the company within 5 working days from the invoice date, otherwise no claim can be entertained
- IMPORTANT – do not send any goods back without contacting us first We will then advise the best means of return
- Once worn the clothing cannot be returned unless because or product fault.
NOTE: WE DO NOT OFFER A SALE OR RETURN POLICY
11. Liability
The company will not be liable for any costs in excess of the original purchase price of goods.
12. PB product warranty
Linebreak product are covered under the manufacturers warranty and subject to the use and washing terms within. Warranties will be invalid if, in the companies view, the product has been misused, damaged or manufacturers guideline ignored.
13. Notices
Any notices hereunder may be sent by letter or fax to the buyer at the address of the buyer to which invoices are sent by PB, and shall be deemed to have been received with 48 hours of postage. In proving service it shall be sufficient to prove despatch.
14. Law
All contracts by Perform Better for the sales of goods shall be deemed in all respects to be contracts made, performed and construed according to English Law.
15. Note
A copy of these terms of trading are available upon request. The Company reserves the right to amend these terms or prices without prior notice. All prices are correct at time of going to press. All product specifications may change due to manufacturers product development without prior notification.
All trade names are acknowledged.
These terms apply to all sales by PB to the exclusion of any other terms unless otherwise agreed in writing with a Company Director
